Terms of Service
These Terms of Service govern the use of MilMap, the online mapping, navigation and location platform operated by Onavan B.V. Please read them carefully before creating an account or using the service. By using MilMap, you agree to these terms.

1. Definitions
In these Terms of Service, the following capitalised terms have the meanings set out below:
- Onavan / we: Onavan B.V., established in the Netherlands, trading under the name MilMap; the provider of the Service and data controller within the meaning of the GDPR.
- MilMap: the online mapping, navigation and location service operated by Onavan, offered via the website, PWA, web application and mobile apps.
- Service: all functionality, software, API integrations, maps, route and navigation features, location features, chat and other services offered through MilMap.
- User / you: any natural person or legal entity that uses MilMap or creates an Account.
- Account: the personal user environment within MilMap.
- Content: all data, routes, locations, maps, markers, waypoints, uploads, coordinates, messages and other information created, posted or shared by Users.
- Subscription: a free or paid plan for using the Service, as described in the article on subscriptions.
- Sub-processor / third-party APIs: external services and systems of third parties that MilMap uses to deliver (parts of) the Service.
- GDPR: the General Data Protection Regulation (Regulation (EU) 2016/679).
- End-to-end encryption (E2EE): encryption whereby messages are encrypted exclusively on the sender's device and decrypted only on the recipient's device, so that intermediate parties — including MilMap — cannot read the content.
2. Applicability
- These Terms of Service apply to any use of MilMap, the website, PWA, web application, mobile apps, APIs and all related services provided by Onavan.
- By creating an Account or using MilMap, you confirm that you have read, understood and accepted these terms.
- If you do not agree to these terms (or any part of them), you must immediately stop using MilMap.
- Deviations from or additions to these terms are valid only if confirmed by Onavan in writing or electronically.
- In addition to these terms, the Privacy Policy and, where applicable, the Data Processing Agreement and the Data & Security page apply; together they constitute the agreement between you and MilMap.
Onavan may impose additional terms for specific parts of the Service; such terms then apply in addition to these Terms of Service. In the event of a conflict, a specific provision prevails over a more general one.
3. Description of the Service
MilMap is an online mapping, navigation and location platform (web/PWA and mobile app) aimed at, among others, military personnel, SAR and emergency services, and outdoor, expedition and recreational users. With MilMap you can, among other things:
- search for and mark locations;
- plan routes and navigate;
- create, manage and share maps;
- consult MGRS grid coordinates and perform bearing calculations;
- share your live location with others;
- view weather information and elevation/terrain information;
- collaborate in missions and teams;
- communicate via an end-to-end encrypted chat.
MilMap is a tool that supports planning and navigation and is expressly not a certified, safety-critical or life-saving navigation system. Onavan may add, modify, restrict or remove features at any time; where a change has a material impact on paid features, we will inform you in advance as described in the article on availability, maintenance and changes.
4. Account Registration
An Account is required for certain features. When registering and using your Account:
- you provide accurate, complete and up-to-date information and keep it current;
- you are responsible for keeping your login credentials confidential and, if set, your chat PIN;
- you are responsible for all activity that occurs through your Account;
- you report any suspected unauthorised use as soon as possible via support@milmap.nl.
An Account is intended for one person or — in the case of a Team subscription — for the designated organisational unit and the users linked to it. You may not share login credentials with third parties outside the Account or transfer the Account without Onavan's consent.
5. Minimum Age
To create an Account and use MilMap, you must be at least 16 years old.
If you are under 16, you may use MilMap only with the consent and under the involvement of a parent or legal guardian. This is in line with Article 8 GDPR, which requires the consent or authorisation of the holder of parental responsibility for the provision of information society services to children under the age of 16. In that case, the parent or guardian is jointly responsible for compliance with these terms.
By using MilMap, you confirm that you meet this age requirement or that the required consent has been obtained. Onavan may take reasonable measures to verify age and may suspend or terminate an Account if it appears that the age requirement is not met. 7. Live Location Sharing
MilMap offers the ability to share your live location with persons, teams or missions of your choosing.
- Sharing your live location is entirely voluntary and takes place at your own initiative.
- You decide with whom you share and for how long, and you can stop sharing at any time.
- You are solely responsible for your choice of recipients and for the operational and personal safety risks that disclosure of your location may entail.
- If you share the location of others (for example within a team or mission), you must ensure that you are authorised to do so and that the individuals concerned are aware of it.
Onavan is not responsible for the use that recipients make of shared location data.
8. End-to-End Encryption, Chat and Privacy by Design
MilMap applies privacy by design and privacy by default. Messages in the chat — including group conversations within missions and teams — are end-to-end encrypted by default using sealed-box encryption based on modern, open cryptography (NaCl/libsodium). In concrete terms, this means:
- messages are encrypted exclusively on the sender's device and decrypted only on the recipient's device;
- Onavan and the MilMap servers have no access to the content of encrypted messages; we store only unreadable ciphertext;
- every User has a personal key pair; by default, the private key remains exclusively on your own device and never leaves it in readable form;
- group messages are sealed separately for each recipient, so that only members of the conversation can read them;
- you can optionally enable cross-device synchronisation using a personal chat PIN: your private key is then encrypted locally with a key derived from that PIN (Argon2id) and stored on the server exclusively as unreadable ciphertext. We do not know your PIN and can therefore never decrypt the key.
Without a PIN enabled, keys remain device-bound and messages sealed to a previous device cannot be read back on a new device. Loss of your device or your PIN may therefore mean that encrypted messages become permanently inaccessible; we cannot recover them.
Upon request from competent authorities, Onavan can provide only limited metadata (such as the existence of a conversation or timestamps), never the encrypted content, because we have no technical access to it. 9. Acceptable Use and Prohibited Conduct
You use MilMap exclusively for lawful purposes and in accordance with these terms and applicable laws and regulations. In particular, you may not:
- use MilMap for illegal activities, stalking, harassment or the violation of the rights of others;
- use the Service for offensive military purposes, violence or terrorism;
- carry out cyberattacks, spam, phishing or the distribution of malware;
- query, scrape or data-mine the Service in an automated manner or place a disproportionate load on it;
- circumvent security measures or gain unauthorised access to (parts of) the Service or to the accounts of others;
- copy, decompile or reverse engineer the software or create derivative works, except where permitted by mandatory law;
- resell, rent out or sublicense the Service without Onavan's written consent;
- post or share unlawful, infringing or offensive Content.
In the event of a (suspected) violation, Onavan may suspend or terminate access to the Service, as described in the article on termination and suspension.
10. Subscriptions, Pricing and Payment
MilMap is offered in a free plan and one or more paid plans:
- Starter (free): basic functionality without a time limit.
- Pro: extended functionality, monthly or annually, payable in advance per period.
- Team: for multiple users within one organisation, monthly or annually, payable in advance per period.
Payment and invoicing:
- Payments and subscriptions are processed through our payment service provider Stripe. MilMap itself does not store full card details.
- Prices are displayed on the website and in the app. Unless stated otherwise, amounts quoted for consumers include VAT; for business customers, amounts may be quoted exclusive of VAT.
- Paid subscriptions are automatically renewed for the same period, unless you cancel via your account settings no later than before the renewal date.
- You may cancel a paid subscription at any time; access continues until the end of the period already paid for, and no refund is given for the current period, unless mandatory law provides otherwise.
- In the event of late or failed payment, Onavan may suspend access to paid features until payment has been made.
- Onavan may change prices and subscription plans; changes to recurring prices will be announced in advance and take effect only at the next renewal, so that you can cancel in time.
Right of withdrawal (consumers):
- As a consumer, you have in principle a statutory cooling-off period of 14 days after entering into a distance contract for a paid subscription.
- If you expressly request immediate delivery of the digital service within the cooling-off period and acknowledge that you thereby lose your right of withdrawal once the service has been fully performed, the right of withdrawal lapses accordingly; in the case of partial performance, you owe a proportionate amount.

The right of withdrawal does not apply to the free Starter plan, nor to business customers, except to the extent required by mandatory law.
11. Intellectual Property
All intellectual property rights relating to MilMap — including the software, source code, design, interface, trademarks, logos and technology — are vested exclusively in Onavan or its licensors.
You obtain only a limited, revocable, non-exclusive and non-transferable right to use the Service for the duration of your use and within the limits of these terms. Without prior written consent, you may not copy, modify, decompile, reverse engineer or otherwise reproduce (parts of) MilMap, except to the extent permitted by mandatory law.
Map, weather and elevation data and other data supplied through sub-processors remain subject to the rights and terms of the respective suppliers.
12. User Content and Licence
Content that you create or upload — such as routes, maps, markers, waypoints, notes and messages — remains yours. Onavan claims no ownership of your Content.
In order to provide the Service, you grant Onavan a limited, non-exclusive, royalty-free licence to store, process, back up and display your Content, solely to the extent necessary to provide the Service to you (and to the persons with whom you knowingly share). This licence ends when you delete the Content in question or your Account, subject to reasonable technical retention periods and legal obligations.
For end-to-end encrypted chat messages, Onavan processes only unreadable ciphertext and has no access to the content.
You are solely responsible for your Content and warrant that it does not infringe the rights of third parties and does not violate laws or regulations or these terms. Onavan may remove or disable access to Content that is manifestly unlawful or in breach of these terms.
13. Third-Party APIs (Sub-processors)
For (parts of) the Service, MilMap uses external services of third parties, which act as sub-processors or suppliers. These include:
- Mapbox — map tiles, map rendering and geocoding;
- a weather service API — current weather information and forecasts;
- an elevation API — elevation and terrain data;
- an EU hosting partner — server hosting within the EU;
- Stripe — processing of payments and subscriptions;
- an email/SMTP service — delivery of transactional email.
To the extent that these parties process personal data on behalf of Onavan, this is done under a data processing agreement and in accordance with the GDPR. Location data is not sold and is not used for advertising. An up-to-date list of sub-processors and the data they process can be found in the Privacy Policy and the Data Processing Agreement.
Onavan does not guarantee that third-party services are permanently available, error-free or accurate and is not liable for failures, errors or damage attributable to these third parties. The use of third-party data may be subject to additional terms of those third parties.
14. Privacy and Data Protection
Onavan is the data controller within the meaning of the GDPR and processes personal data in accordance with the principles of privacy by design and privacy by default and of data minimisation: we do not process more data than is necessary to provide the Service.
As a data subject, you have the right under the GDPR to access, rectification, erasure, restriction of processing, objection and data portability, as well as the right to withdraw previously given consent. You can exercise these rights via privacy@milmap.nl.
If you believe that we do not handle your data with due care, you have the right to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).
How we process personal data, on what legal basis and for how long we retain it, is described in the Privacy Policy. For business customers and teams, the Data Processing Agreement additionally applies; our technical and organisational security measures are described on the Data & Security page.
15. Availability, Maintenance and Changes
MilMap is provided on an "as is" and "as available" basis. Onavan strives for high availability but does not guarantee uninterrupted or error-free operation.
- Maintenance, updates, outages and causes beyond our control (including at sub-processors) may result in temporary interruptions or limitations.
- Planned maintenance with an expected noticeable impact will, where reasonably possible, be announced in advance, for example via the status page or by email.
- Onavan may further develop, modify or discontinue the Service and individual features. In the event of changes with material adverse consequences for paid features, we will inform you in advance and you may cancel your subscription in accordance with the article on subscriptions, pricing and payment.
- Certain features may be offered as beta, preview or experimental; these may be unstable, contain errors and be changed or removed without notice. Use of such features is entirely at your own risk.
16. Liability and Indemnification
Use of MilMap is at your own expense and risk.
To the extent permitted by law:
- Onavan is liable only for direct damage and only in the event of intent or deliberate recklessness on the part of Onavan;
- Onavan is not liable for indirect damage, consequential damage, loss of profit, loss of data, personal injury, incorrect or deviating navigation, downtime or safety incidents;
- Onavan's total liability per event and per year is limited to the amount you paid for the Service in the twelve months preceding the event giving rise to the damage; if you have paid nothing, liability is limited to EUR 0.
These limitations do not apply to liability that cannot be excluded or limited under mandatory law.
You indemnify Onavan against claims by third parties arising from your use of the Service, your Content or your breach of these terms or of the rights of third parties.
17. Termination and Suspension
You may terminate your Account and subscription at any time via the account settings. Upon cancellation of a paid subscription, access continues until the end of the paid period, without any refund of amounts already paid, unless mandatory law provides otherwise.
Onavan may suspend or terminate an Account or access to (parts of) the Service if:
- there is abuse, fraud or an (imminent) breach of these terms;
- this is necessary for the security or integrity of the Service or of other users;
- a legal obligation or an order from a competent authority so requires.
Where reasonable, we will warn you in advance and give you the opportunity to remedy a breach, unless urgency or the nature of the violation does not permit this.
After termination of the Account, the associated Content will be permanently deleted after a reasonable period, as further described in the Privacy Policy. You are responsible for exporting your data in good time (for example as GPX/KML). Provisions that by their nature are intended to survive termination — including intellectual property, liability and governing law — remain in force.
18. Changes to These Terms
Onavan may amend these Terms of Service from time to time, for example due to new functionality or changes in laws and regulations.
- Changes will be announced to registered users at least 14 days before they take effect, for example by email or via the app.
- The most recent version is always available on the website, stating the date of the last change.
- Continued use of MilMap after the changes take effect constitutes acceptance of the amended terms. If you do not agree, you may terminate your Account before the effective date.
19. Governing Law and Disputes
These Terms of Service and all agreements between you and Onavan are governed exclusively by Dutch law.
Disputes will be submitted to the competent Dutch court, unless mandatory law designates another court. As a consumer, you may also bring proceedings before the court of your place of residence to the extent the law grants you that right.
We invite you to first try to resolve a dispute together by contacting us at support@milmap.nl before bringing it before a court.
